We Got Talent Oy Privacy Policy statement
We Got Talent Oy collects personal data of its customers and visitors of its websites and digital services whilst providing its services, including the Careers Zone matchmaking platform.

We Got Talent Oy processes your data with due care, in accordance with all applicable laws and regulations, including the EU General Data Protection Regulation (GDPR) and applicable Finnish data protection law.

Our Privacy Statement explains what data we process, how we do that and how you may use your rights as a data subject (e.g. right to object, right of access).

This Privacy Statement constitutes a description of the data file of the users of our services and websites.

This Privacy Statement may be updated from time to time. You can find the current version on our website Privacy Policy. This Privacy Statement applies to all personal data that We Got Talent processes during the execution of our services, including the personal data of visitors of the We Got Talent websites and users of the Careers Zone platform.

This Privacy Statement only covers data processing carried out by We Got Talent. The Privacy Statement does not address, and we are not responsible for the privacy practices of any third parties (such as event organisers, partner companies or recruiters) acting as independent controllers for their own purposes.

For the development, hosting and technical operation of the Careers Zone platform, We Got Talent uses Intelligent Solutions Finland Oy as a technical service provider and data processor, under a written data processing agreement.

In connection with certain events, such as Pocket Gamer Connects conferences, We Got Talent cooperates with Steel Media Ltd and related entities. These event organisers are independent controllers for their own activities (ticketing, event apps, marketing etc.), and their own privacy policies apply to that processing.
2. Personal data processed and sources of data

We Got Talent collects information from our Users: (i) User Data; and (ii) Technical Data. Although we do not normally use Technical Data to identify you as an individual, you can sometimes be recognized from it. In such situations, Technical Data can also be considered personal data under applicable laws.

We may collect and process the following User Data about our customers and visitors, depending on how you interact with us (as a candidate, recruiter or event participant):

• First and last name
• Contact details: address details, email address, telephone number, country/city, preferred language
• Professional information (especially for Careers Zone candidates):
  – Job title, skills, seniority level, technologies and tools
  – Employment preferences (onsite/remote/hybrid, full-time/part-time/freelance, relocation, salary expectations if provided)
  – Links to profiles (e.g. LinkedIn, portfolio, GitHub, company or personal website)
• Resumes / CVs and career history: work experience, education, certifications, projects, game titles or apps, references
• Event–related data:
  – Event registrations and ticket type
  – Participation in Careers Zone or other recruitment programmes at events (e.g. Pocket Gamer Connects)
  – Meetings or time slots scheduled with companies, attendance to onsite or virtual sessions
• Recruiter / company information:
  – Company name, size, industry, location
  – Recruiter user details (name, title, business email, phone)
  – Job descriptions, requirements and other information about open roles
• Payment details where necessary for paid services
• Other personal data you provide yourself in your CV, in correspondence, by phone or verbal communication, software or in person: language skills, interests, training information, hometown, images, gender and other profile information you choose to submit. We ask you not to include sensitive personal data (such as health, political or religious information) unless it is explicitly requested, permitted by law and you choose to provide it.

• We Got Talent also reserves the right to share images or video footage of Users on our websites and on social media, that are produced as a result of meetings, events or any other activities organised by We Got Talent team, in accordance with applicable law and event rules.

We may collect User Data from our customers and visitors in a variety of ways, including when they:

• Register to our services (including Careers Zone)
• Subscribe to a newsletter
• Fill out a form on our websites or platforms
• Take part in a recruitment event or programme
• Participate in email correspondence or communicate with us in person or through the Careers Zone platform.

Further, we also collect details of any transactions and payments between us and the data subjects. We will collect User Data from customers and visitors only if they voluntarily submit such information to us.

We and/or our authorized third-party service providers may automatically collect Technical Data when you visit or interact with our services or sites.

Technical Data may include the browser name, the type of computer or device, time spent on website, interaction with the Services, URL of the website you visited before and after visiting the Services, the time and date of user visits, surfing habits, IP address, operating system and the Internet service providers utilized and other similar technical information.

Cookies

We use various technologies to collect and store information when you visit a We Got Talent Oy website or use our Services, including cookies and similar technologies. Cookies allow us to calculate the aggregate number of people visiting our websites and monitor the use of the websites. This helps us to improve our websites and better serve our users. We also use cookies that make the use of the website easier for you, for example by remembering usernames, passwords and (language) preferences.

We also use tracking and analytics cookies to see how well our services are being received by our users and how our campaigns and events perform.

Tools and services we use to store personal data include for example:

We use a number of third-party systems to deliver and support our services. These include, among others:

• Zoho Recruit Applicant Tracking System (ATS) – used as our main recruitment database and applicant tracking system to store, organise and manage candidate profiles and applications collected via Careers Zone and other We Got Talent channels. Candidate data such as contact details, CVs, experience, skills, preferences and application status may be stored and processed in Zoho Recruit.
• Other Zoho products (for example CRM and communication tools)
• Event and ticketing systems such as Eventbrite
• Email and marketing tools such as Mailchimp and HubSpot
• Communication and social media platforms such as Facebook and LinkedIn
• Platforms such as Outsystems, theHub, Stack Overflow and others, where relevant
• Websites and event platforms such as Tilda and PINE
• The technical platform provided by Intelligent Solutions Finland Oy for the operation of Careers Zone.

All such service providers act as data processors on behalf of We Got Talent when they handle personal data for us, and we use appropriate contractual and security measures to protect your data.

Our sites use Google Analytics and other web analytics services to compile reports on visitor usage and to help us improve our sites and services. You can opt-out of Google Analytics with the relevant browser add-on provided by Google.

We use platforms such as, Zoho Recruit, and our own Careers Zone platform for storing your candidate profiles and resumes and for enabling recruiters to search and contact you where appropriate.


3. Purposes and legitimate grounds for the processing of your personal data
There are several purposes of the processing of your personal data by We Got Talent:

To provide our services and carry out our agreement with you

We Got Talent processes your personal data in the first place to be able to deliver our services to you and to run, maintain and develop our businesses. This includes, for example:

• Operating the Careers Zone matchmaking platform, including AI-supported matching between candidates and open roles
• Handling your registrations to our events and recruitment programmes
• Facilitating communication and meeting booking between candidates and recruiters
• Handling your payments, where applicable
• Providing access to partner companies and event organisers when you sign up to a relevant programme
• Contacting you regarding your registration to one of our events or services.

If you contact our customer service, we will use the information provided by you to answer your questions or solve your complaint.

In order to ensure that our services are in line with your needs, these data can be used for things like customer satisfaction surveys. We might also request another party to do this for us.

For customer communication (including marketing)

We Got Talent processes your personal data to contact you regarding our services and to inform you of changes to our services and products. Your data are also used for research and analysis to improve our services and our websites. We may also use your data entered on our websites in certain cases to send information by email about other services or events of We Got Talent to you, where permitted by law. You can opt out of direct marketing at any time.

For quality improvement, analytics, matching optimisation and trend analysis

We may also process information about your use of the services, including Careers Zone, to improve the quality of our services e.g. by analyzing any trends in the use of our services. When possible, we will do this using only aggregated, non-personally identifiable data.

Our matching and recommendation features may use profiling (for example, automated analysis of your skills, role preferences and activity) to suggest relevant jobs or candidates. These features are used to support human decision-making in recruitment; final hiring decisions are always made by people, not solely by automated systems.

Legitimate grounds for processing

We Got Talent processes your personal data:

• To perform our contractual obligations towards you (for example when you create an account, register for an event or use Careers Zone);
• To comply with legal obligations (for example, accounting and certain regulatory requirements); and
• To pursue our legitimate interest to maintain and develop our businesses, manage our customer and partner relationships, organise events and recruitment programmes, and improve the user experience and security of our services.

Where required by law (for example for certain types of marketing or for some event-related uses of your data), we will ask for your consent and you may withdraw it at any time.
4. Transfer to countries outside Europe
We Got Talent may transfer your personal data to countries outside the European Union and the European Economic Area. When we transfer any data to a country for which no adequacy decision of the European Commission exists, such transfer will be subject to the provisions of the standard or other clauses adopted by the European Commission or other appropriate safeguards.

In cases where personal data is transferred to countries outside the European Union and the European Economic Area, all such transfers are made as safely as possible. All partners of We Got Talent are handling all transfers of personal data safely, following EU compliant methods for transferring personal data.

5. Recipients
We only share your personal data within the organization of We Got Talent if and as far as reasonably necessary to perform and develop our services, e.g. with our customer service, recruitment, product development and marketing employees.

Your personal data will be shared, where relevant, with:

• Steel Media Ltd, organiser of Pocket Gamer Connects, when you participate in Careers Zone or other recruitment programmes at their events and such sharing is necessary to coordinate meetings, recruitment zones and related services.
• Partner companies and studios (our “Partners”) that have a Service Agreement and Data Processing Agreement with We Got Talent, where sharing is necessary for recruitment and matchmaking, such as when you:
  – Apply to a particular role, or
  – Join a specific recruitment event or programme involving those partners, or
  – Are recommended to them through Careers Zone in line with your profile and preferences.
• Companies and studios using the Careers Zone for recruitment purposes (“Recruiters”), who are granted access to candidate data through the platform so they can review profiles, receive applications and contact candidates.:
These companies and studios are independent controllers for their own recruitment processes and must process your data in accordance with their own privacy notices and applicable law. 
We do not share your personal data with third parties outside of We Got Talent and the relevant Partners unless one of the following circumstances applies:

It is necessary for the purposes of this Privacy Statement

To the extent that third parties need access to personal data to perform such services, We Got Talent has taken the appropriate contractual and organizational measures to ensure that your data are processed exclusively for the purposes specified in this Privacy Statement and in accordance with all applicable laws and regulations.

Furthermore, we may provide your personal data to our affiliates or other trusted businesses or persons (such as Intelligent Solutions Finland Oy as platform developer and host, and other IT service providers) to process it for us in accordance with our Privacy Statement and any other appropriate obligations of confidentiality and security measures.

For legal reasons

We may share your personal data with third parties outside We Got Talent if we have a good-faith belief that access to and use of the personal data is reasonably necessary to:

(i) meet any applicable law, regulation, and/or court order;
(ii) detect, prevent, or otherwise address fraud, security or technical issues; and/or
(iii) protect the interests, properties or safety of We Got Talent, our users or the public as far as in accordance with the law.

When possible, we will inform you about such processing.

With your explicit consent

We may share your personal data with third parties outside We Got Talent for other reasons than the ones mentioned before, when we have your explicit consent to do so, unless such sharing is already necessary for the provision of our services (for example sharing your profile with a company you apply to).

You have the right to withdraw this consent at all times.

6. Storage period
We Got Talent does not store your personal data longer than is legally permitted and necessary for the purposes for which the data were collected. The storage period depends on the nature of the information and the purposes of processing. The maximum period may therefore vary per use.

In general:

• We store CVs and candidate profiles for as long as it’s necessary to provide the service unless you request deletion.
• Other personal data related to our customer and partner relationships may be stored for as long as there is a valid contractual or legitimate interest (for example, as long as you receive our services or participate in our events and for a reasonable period after that), or as required by law.
• Newsletter and marketing contact data are stored as long as you have not unsubscribed or objected, and for a limited period thereafter for record-keeping.

In case of a request for deletion of all personal data, we will comply within a reasonable timeline. We may not immediately be able to delete all residual copies from our active servers and backup systems, but such data will eventually be deleted in accordance with our backup and retention policies.

In cases where personal data has been shared with third parties, the third party's privacy policy applies to their further processing. In cases where your personal data has been shared with third parties, all your deletion or access requests will be forwarded to them as appropriate, along with a request to comply within a reasonable timeframe. 7. Your rights
Right to access

We Got Talent Oy offers you access to the personal data we process. This means you can contact us asking us to inform you about your personal data that we have collected and processed and the purposes such data are used for. Requests can be initiated by sending email to contact@gamesfactorytalents.com, this applies to all Data Subject Access requests.

Right to correct

You have the right to have incorrect/unprecise, incomplete, outdated, or unnecessary personal data we have stored about you corrected or completed by contacting us.

Right to deletion

You may also ask us to delete your personal data from our systems. We will comply with such request unless we have a legitimate ground to not delete the data. After the data have been deleted, we may not immediately be able to delete all residual copies from our active servers and backup systems.

Right to object

You may object to certain usage of your personal data if such data are processed for other purposes than necessary for the performance of our services or for compliance with a legal obligation. You may also object any further processing of your personal data after prior given consent. If you object to the further processing of your personal data, this may lead to fewer possibilities to use our websites and other services.

You have the right to opt out of receiving electronic direct marketing communications from us by clicking on the opt-out link provided in all marketing communications we send you and choosing not to receive marketing communications from us in the future. You also have the right to prohibit us from using your personal data for direct marketing purposes, market research and profiling by contacting us on the addresses indicated above.

Right to restriction of processing

You may request us to restrict certain processing of your personal data. If you restrict certain processing of your personal data, this may lead to fewer possibilities to use our websites and other services.

How to use your rights

You may use these rights by sending a letter or email, including your name, email address used when submitting the personal data and a copy of a valid ID to us on the addresses set out above. We may request additional information if necessary to confirm your identity. If your request regards personal data in a cookie, you have to enclose a copy of the said cookie. We may reject requests that are unreasonably repetitive, excessive or manifestly unfounded. In case you consider our processing activities of your personal data to be inconsistent with the applicable data protection laws, you may lodge a complaint with the local supervisory authority for data protection.
8. Information security
We will take all reasonable, appropriate security measures to protect We Got Talent Oy solutions, services and customers from unauthorized access to or unauthorized alteration, disclosure or destruction of personal data we hold. Measures include, where appropriate, encryption, firewalls, secure facilities and access rights systems. Should despite of the security measures, a security breach occur that is likely to have negative effects to your privacy, we will inform you about the breach as soon as reasonably possible and as directed by the Data Protection Authority.

Our Privacy Statement applies worldwide, to all of the services offered by We Got Talent Oy including the Careers Zone platform and other recruitment-related services and events.
